What to do? Advice

Update: The superintendent has denied my request due to what they said are "liability issues." No idea what that means. Oh well. The sweet treasures of the school yards will have to stay buried for now I guess.

You still have recourse. You can appeal the decision to the school board. But, if you do, you better be very prepared to make your case! They hired the Superintendent, so he or she is their person, and they are not likely to counter his or her decision, but, they are the higher authority, and they are there to represent "the people". So go for it, at this point you have nothing to lose, and much to gain. Recruit some other area metal detectorists, and do it together--I highly recommend that you make it a group effort. There is strength in numbers, and the board will see that you are not the only person that wants to do this, and you will greatly enhance your position.

To you newbs out there: Don't put yourself and the hobby in jeopardy by ignoring NO TRESPASSING signs as is being intimated above. Until told otherwise by the proper authority do the smart thing and assume that NO TRESPASSING means just that. To do otherwise is pure folly, and for the life of me I cannot understand how posts saying otherwise are allowed to stand. :roll:

I'm glad the OP had the good sense to realize this and I wish him a positive result.

I will never hunt a posted "no trespassing" site unless I have gotten a written permisssion slip beforehand, and everybody else here shouldn't either. I've had less fun that way, cuz I know for certain that there are rogue metal detectors who get the silvers-gravy by slipping in and out before getting attention drawn. Me? I'm proud to state that I surely over-think stepping over the line when I'm next to a delicious looking old property next to my spot I've chosen to detect. I don't stray a foot away from my known permission.

Sadly, I've witnessed other tectors during hunts do just that...so-called cheat the permissions system. That's always made me nervous being it's a group hunt. I've also lost some friends over that as well, even though they never really knew why.

I think a person has to look at each situation for what it is. If you walked past a school on a week-end and there were No Trespassing signs posted and there were people playing basketball,throwing frisbee (yes, got it in there) and playing tennis would you not metal detect there?

This could get outta hand and back into the same arguement as before.

But the best possible and still neutral answer to this question is that posted signs are the law , obey the signs and you have nothing to worry about.

If you saw the door open at a store that is usually closes on the weekends, and there were people in that store getting everything for free since the door was unlocked, would you go in and get some free stuff?

Same difference, both scenarios are breaking the law, and you CAN be arrested for trespassing!

cracker-jack, that may be all fine and well. But the fact remains: Most of the time when we md'rs hear this "liability" thing, the truth is: that the person simply doesn't want to be bothered. Because even if you close that loophole for the person, by given them a "written releases of liability" (correctly-written), notice that they don't want to hear about it. They're still not interested. Thus they're just reaching for a "go to" reason, as the way to deflect you.

Because even if it's true that provisions can be made to cover this legal angle, yet .... think about it: It just requires them to have to read minutia, take time out of their busy day to sort look over a paper. Or risk that now other yahoos are going to want to come wasting his time now too, etc... Hence, what do you think the easy answer will be ?

Nector, I know what you're trying to say, but ... the example doesn't lend itself to your desired outcome. I mean, think about it: If you were driving down the street, and saw some people playing tennis in the school courts on the weekend, or jogging the track, etc... what would you think? Probably nothing. It wouldn't even register on you, right? However, if you were driving down the street and saw people looting a store, what would you think? Thus for some reason, this is like bank-robberies to jay-walking type of example.

I guess the bottom line is, that if we use the "joggers" as rationale to justify the "no one *really* cares" excuse, it simply back-fires, eh ? I mean, here's what we'd need to say: the jogger is a) breaking the law, and b) should have asked "can I jog?"

I don't think those joggers or kids playing ball go over THOSE type fences, to enter an ordinary school! ha As for md'rs going over fences like that, would depend on how many gold coins are on the other side. durnit, I keep falling prey to instinctive knee-jerk reaction, and adding inputs. As opposed to linking posters to where I'd previously written out on whatever-particular in the past. Probably because I inititally see something as a "new" slant, and not something that was discussed in the past. But after I hit "post", I then sometimes realize that it WAS something that came up in the past.

Forgive me for failing my resolve folks. Let me put a yellow stickee across my 'puter screen! Aagggghhh

I worked in three prisons as a pipefitter. I'm not going into one and wearing my pants backwards due to stupidity.

Point was that just because others are doing something illegal doesn't mean that you should too... that's the cliff notes version....

You conveniently left out part of this... the jogger should have asked "can I jog in this area that is posted No Trespassing..

This is one of the dumbest reasons (IMO) guys get denied to metal detect Public Property. Its not just Public schools that use this piss poor excuse but its also Public parks. Crazy that over 200,000 kids are injured on public playground equipment every year and i believe it was a little over a 100 die in the united states, yet every Public park and School in my area has a Children's jungle gym. If asking made you feel better about detecting then you did the right thing but truth be told (IMO) you didnt have to.

Hey thanks for showing me that i didnt see it, but lets not "lol" the Facts* i posted above showing how stupid the response the OP got from a Public School Superintendent IS. Its all just a bunch of BS and not really a "liability issue" but more of a "go-to-response" to a quirky question. OK, but thanks for the link. lol....
