Is the jewelry you find on beaches yours to keep

Laws and regulations are out of control at all levels; Fed, state & local. I guarantee we all violate some law or regulation everyday that could potentially result in a fine or jail time. We have too many damn laws!

One mans trash is another's treasure.
I'm gonna take all my clad, pull tabs and slaw down the cop shop and demand they are returned to their rightful owners.

I returned a WW2 dog tag to the soldiers daughter... she never even said thanks. I learned a lesson that day, and the lesson was what I find is mine unless I WANT to return it.

I know right, I've tried to do this with a number of rings and to no avail they do not want them back. I did a class ring to the first all Black College in the US, name date everything, class ring and they just don't want to waste the time to help.....

Your right it's yours mine and ours.... just don't have anyone say they lost something while your hunting in front of them otherwise you will get tackled every time the detector beeps or you start to hunt... This family lost a ring, I said I would help and they followed me all over the place.. LOL... I suppose I would do the same so.... but yes I find it I keep it.....:p

When someone on the beach asks, I say have found "2 pennies and a dime". Bet you I have said that phrase 200 times :laughing:

I always say "A couple pennies and fishing hooks and a nail" They smile when they know I'm taking the hooks off the beach. Funny how you can hear them go tell people "She's finding fishing hooks!"

And the nice thing is I know that fishing hook sound all too well and always dig them and take them with me. I consider it my good deed for the day.

Here's one for ya :) 823.01 Nuisances; penalty.
All nuisances that tend to annoy the community, injure the health of the citizens in general, or corrupt the public morals are misdemeanors of the second degree, punishable as provided in s. 775.083, except that a violation of s. 823.10 is a felony of the third degree.

ok, here goes.....

i have never yet whilst detecting found anything such as valuable jewelry that's been "lost" because we ALL know no one out there is dumb enough to wear a 5 or 10 thousand dollar ring to an area such as a beach!

so the question comes to mind about how did such and such an object get to be where it is?
easy: it was deliberately thrown there!! and since that's the case without a doubt, then it belongs to whoever has the good luck of finding said object.... ring, watch, pulltab, you name it. the person didn't want it anymore, so in our own pocket it goes, or in the case of the many items of trash we often find, we properly dispose of it and not just throw it in the sand.
as for the topic of WHY someone would throw away a perfectly good ring, watch, pulltab, there are many possible reasons: lovers spat, nasty divorce, their garbage bag was already too full, etc, etc.
if someone asks me to come to their yard and search for a specific and genuine lost item, sure no problem and if found it gets returned to them. otherwise, it's mine.

I like how you think!

Yes I think the law says any found object of value must be turned in to the police and if no one claims it in 30 days it's yours. Now, take my word for it, someone will claim it. I keep what I find unless it has a name or a class ring with initials in it I can return myself.

Here in Michigan If you turn it in to the police, they keep it for 1 year. If it goes unclaimed you get to have it. I think most Police departments are pretty honest. They have to make a report if it gets claimed, so they can't really take it without a paper trail. Not to mention, most cops are generally law abiding decent folks, despite the recent cop-bashing.

I turned in a decent amount of cash that I found in a snowy gas station parking lot a few years ago. I told the gas station clerk that I found money in the parking lot and that if someone came looking for their lost cash, it would be at the Police dept. I did not tell her the amount. One year later, I got a call to come get the money.

I have found numerous items of value, these are just off the top of my head.

Car remote and cellphone returned to owner: received a thank you

Children s necklace with a charm and phone number. Called the number to return it: the guy yelled at me for calling him about it

And this is a kicker. Found a mini SD card. I was going to reformat it and use as a spare but there were lots of pics. Also a picture of a business card. Korean Air line hostess to be exact. Called and asked her if she would like it back, we agreed to meet not far from my place. We met and she offered to buy me a coffee! :p So we are sitting at the coffee shop and she is asking where I found it and so on. 10 minutes later the police show up! :wow: They take us to a police station and they grill me for about 2 hours!
Apparently the SD card was lost two weeks ago, and this nutty hostess thought I was up to something. In the end no apology, no nothing just wasted two hours of my time.

I am a nice person, but from here on out I ain't returning nothing to nobody.

Wow I wonder who the elitist was that authored that. FELONY! JAIL! = more court clerk jobs. I'd bet some ones back pocket was padded to slip that in.

And I thought mass law was overbearing. Hh gl -Joe

I'm not a holy roller, but here comes a sermon.

Don't mind saying that most of the responses to this thread, if seriously meant as stated, are troubling. We have each agreed to abide by the MDers code of conduct regarding adherence to local and federal regulations for found objects just like we have agreed to refill our dug holes, just like we have agreed to not search in cemeteries. There's no difference in how we should obey one regulation versus another. Either you observe all the rules or please get out of the hobby and stop ruining it for the people that are willing to follow *all* the rules. The rules are not multiple choice where you pick 3 out of 4 or 9 out of 10, and only observe those.

Have personally found a few items of jewelry (man's gold wedding ring, a sterling friendship ring, sterling charm bracelet) that valued IMO over $100, so turned them in to the local police for the 90 day holding period. The cop that helped me made out a police report, give me his card, and wrote the case number on the card, all without my asking. After the 90 hold, I got the items back from the evidence room clerk without any issue.

Some of you may want to make fun of this response and you can have at it. But remember that the attitudes reflected in this forum are also read by people who simply want to find out what MDers really think and therefor how they will act in the field. Your choice - as always.

End of sermon.

It's one thing to watch something fall to the ground and not speak up , or if I ever found a purse or lost wallet , a cell phone or somethin like a class ring that is a bit more returnable even with a little leg work.
It's also honorable when diggin a property that a family has held for ever if something is found to share .
but if I'm in a park or on a beach or school ground and dig something that has been lost a long time . Down in the ground or a 100 dollar bill tumbleweeds over my feet and I can't find a soul wandering around looking for it or a sign stapled to a telephone pole . It's mine. ! Love that photo from the movie . Mine. Mine mine mine :) . I do believe in karma when it comes to detecting and If I think something needs to find it's way back to it's owner I will try my best to get it home to them. HH , Dew

Speaking of metal detecting code of ethics!
Why is it that all if the nice pretty items I find (as few they may be)
Always get snatched and grabbed by my wife? Never to be shared or returned to me? Talk about mine ! Mine! Mine! Geeze!
You will notice I don't have a single 925 or 14 k in my below signature.
Welp , I have excepted the fact that I never will. I do have a sterling is bracelet that says love jenny , a sterling Cub Scout ring and another ring marked 925 that is obviously plated junk but I am in denial so I have it in my silver finds pile :( bits nice ! But somehow for some reason she doesn't snatch that?
What gives? HH Dew

I am thinking the Owners/Admins/Moderators here could use this statue here on the Forum! ;):p:laughing::laughing:

I was working near a promenade and .........

I was metal detecting a promenade near the beach and a lady came up to me asked if I was looking for "the ring". I asked if their had been a ring lost, she replied yes, she had seen the lost report at the police station she worked at. She was in plains clothes, it looked as if she was trying to find the ring for herself.
We talked a bit more and it turns out her police station WAS 20 MILES AWAY, since then I don't take anything to the police lost and found. There was just something not right when I was talking to her.
