Permission Advice - What would you do?

I came across a post on facebook where a guy askef for permission to search for a lost ring in the beach of a National park.(Point Reyes) ...

Funny you should mention Pt. Reyes. That, with GGNR along there, is federal. And supposedly off-limits .

A few years ago, a friend of mine in S.F. got asked to look for a ring that a lady lost "on the beach". As the Lady and my friend scheduled and arranged the search time/date/location, he suddenly realized that the particular beach was part of GGNRA.

Hmmmm, what to do, what to do. He fretted and worried about it, ... wondering if he should contact the federal powers-that-be. In the end, he decided that since his hunt was a legitimate (not contrived) search, that he was just going to print out the email exchange (and CL lost & found ad, etc..) and carry it with him, if anyone said anything to him. We joked with him that he should make sure to make *WIDE CIRCLES* first, around the suspected beach-chair zone she'd been at. *Just* in case it wasn't exactly where she thought (ie.: to "take his time", haha).

He went out, spent a long time there, and no one ever said so much as "boo" to him. Can't remember if he found the ring or not.
 
Ok, I gotta ask, I'm still pretty young around here. . . I love the passion and creativity you put into your posts, and I'm full of sarcasm and dry humor myself, but I'm having a little trouble reading you on this one. . . an honest question here:

Is there any trend of gear being confiscated by law enforcement?

One place I would like to go is owned by Tribal authorities. They will confiscate your equipment if you break their laws. No metal detecting there which sucks since I found out a lady dropped her 5K wedding ring on a beach there.

Chris, I notice you're from NV. California, as well, has many Indian reservations. Of which, I may or may not know persons who have md'd on those locations (as many of them are simply public access, public roads that criss-cross through them, etc....)

So ... based on your quote, I'll bite: Do you know of anyone who's had their detectors confiscated by Indians ?

NOPE! As long as I've been participating in the Sport and reading the forums, Not in one instance can I verify that one of us has EVER had our Metal Detecting Gear confiscated....

I hunt all around here in the parks and Stadiums and beaches.....theres signs that say: No Golfing, No Dogs, No Smoking, No Alcoholic beverages, No skateboarding...etc...Although rare, Some signs even say No Metal detecting...yet the evidence is everywhere that all of these outlawed shenanigans are going on with reckless abandon....

Never once in my knowledge has a Dog ever been confiscated, or golf clubs, or a pack of cigarettes, or a can of beer, or a skateboard....the in field evidence proves otherwise...so hey...Your concerns can be laid to rest... Nothing to worry about...

This said, I did lose a rod and reel to a Game Warden once..back in 1979...the sign clearly said 'No Fishing'...He took my Zebco 202 and dumped out my bucket of bluegills but never gave me a ticket..He gave me a stern tongue lashing....Since he had a badge and a gun, I acted admonished and contrite appropriately..

Did I quit fishing on account of this one off lightening strike?...No, I learned a valuable lesson about Timing...! :laughing:

To expand : There HAVE been VERY RARE examples given on threads on-this-subject. When I have tossed out the challenge in the past, there *has* been a few links floated. HOWEVER, in each and every case, it was always :

a) someone snooping around an obvious historic sensitive monument

b) someone being obstinate, who couldn't take a warning.

c) someone who, with an ounce of sense, could have known better (eg.: waltzing over beach blankets at an archaeologist convention, etc....)

Well yeah..that one guy who rode his bicycle down into the Gettysburg battlefield every single night and was pulling breastplates and CSA buckles for 20+yrs with a Bounty Hunter?...Living in a backyard shed at his Sisters house....Selling buckles and buttons and CW paraphenalia on the Ebay for beer money??>Yeah! That guy is famous!..

Then, after 20+ years of a nightly Gettysburg battlefield raids and ransacks, (so serene and peaceful) he got caught on account of some sort of accidental trail cams or some damned thing?....So the feds came in and kicked down his shed door with a full Swat team like arresting Roger Stone! I think a Lawnmower got killed in the scuffle, along with a 12 pack..it was one hell of a mess if I remember...I dont know the final legal outcome, but I suspect this guy is chilling heels in Leavenworth solitary, or maybe out hunting totters on good behavior?

Yeah.. Thats the only one I've ever heard about having his gear confiscated...Not like the guy hunting the Little Bighorn Custer Battlefield site..Oh yeah, we dont know that guy..he musta had one hell of a dog!..And I do...:laughing:..Plus, thats Crow Territory! ... so European rules and enforcement dont apply!!.

The way I recall the story, is that some park rangers became suspicious because they could see evidence of dig marks, seen during the day. So ... on that hunch .... they staked it out on subsequent nights, and got him.

Yes, it was amazing that he'd done it for years and years. I mean, gee, what happened to the "cameras that record your every move" and "navy commando seal archies" that certainly lurk behind every tree watching our every moves ? :laughing:

Ok, durned that dumb md'r who couldn't be a little neater and leave no trace of his extractions ! He needs to repeat the "target recovery 101 class.

I do not. I do know people that hunted on this tribal land that had their guns confiscated. I know guys that got fined for opening a truck door and urinating behind the door instead of finding a portable toilet that may or may not be on one of these beaches. They don’t mess around on this particular reservation and it’s heavily patrolled. Including giving fines for parking to close to the water.
 
Same for the numbskull who had the book thrown at him @ the drought-stricken Folsom reservoir a few years ago. The link of his "ticket" made the rounds on md'ing forums.

But if he'd had an ounce of common sense, he'd have known that the revealed foundations were becoming a media curiosity circus. Which, of course, brought out archies for interviews, inspections, etc.... Lo & behold the Radio shack/Bounty hunter newbie is spotted by the crowd. I mean ... sheesk, that's a case where someone with an ounce of common sense could have known better. NOT a case where "oh no, everyone hates us and we're all doomed to get confiscations at every turn"

Ok. Thanx for the answer. Moral of the story: 1) Don't hunt with guns on private tribal land, 2) don't urinate behind your car door, 3) Don't park close to the water.

I have no doubt that there are sometimes over-zealous cops who might throw the book at someone for peeing or jay-walking. I even have a newspaper clipping of a guy who got a ticket for eating a hamburger while driving (the cop called it "distracted driving").

There will ALWAYS be flukes in life. And sure, don't throw "caution to the wind" in places where over-zealous tribal cops roam, waiting to bust people's chops. I too know of places (millionaire enclaves, for example) where ... sure ... we have to "mind our P's & Q's" a little better than other places we hunt.
 
Man, mud puppy, your stories sure take a while to digest and decipher if you're making it up or just embellishing a true story. :)

This has become the norm for this lake(Pyramid Lake). It wasn’t like this ten years ago but now that it has become a major fishing destination the tribal authorities have become over zealous. If anyone wants to try finding the 5K ring it’s at South Nets Beach midway on the beach. Was in 4 feet of water two years ago. Not sure if what depth it would be at now?
 
In my experience a face to face contact is 20 times more effective than any other method. And having a good business card to present is worth it’s weight in gold.
 
Probably Upper and Lower Pyramid City. I looked fir bottles there when I was a teenager.


Good guess. No, it wasn't there. It was 20 to 25-ish miles from there. The guys I know who tried a spot, got some buttons from late 1800s to turn-of-century-ish (suspender clips, henry shells, etc..), and a Chinese cash coin.

And now that I study it on a map, I see that it's on Indian reservation land. However, the back country roads all through these areas are open to the public. I think it has something to do with gaming casinos. If they have casinos, then they have to agree that non-Indians can travel the roads, etc....

The entire time my friends were in this back country spot they'd researched, (several hours) only a single truck ever came by. It just kept driving, and never stopped. Thus basically: They were in the middle of nowhere.

Sweet, maybe at one of the rail road switch stations from the olden days? Built by the Chinese? One of my grandfathers used to run that route as a conductor on the rail. Herlong/Honey Lake going east. There’s also a couple of old ranches out there. Buffalo Meadows has some old stone cabin ruins. All these areas were my stomping grounds as a teenager.

The story about the guy ransacking Gettysburg is TRUE! Maybe somebody can post a link?...I think it hit the news about 5yrs ago? Yep, just an old tosser out for his nightly Gettysburg walkNdig as if he owned the place!:laughing:

I do not know the outcome of his punishment...he didnt have anything of value to confiscate besides his bicycle and his finds...
