Then you agree, that when your friend invites you to his rental house , to watch the football game, that you are trespassing , without valid permission, unless his landlord also gives you that invite/permission. Right ? Don't be inconsistent.

I literally just paid my $500 fine to the US federal courts for finding old cans in the woods and instead of leaving them I took them to throw them away. $250 for artifact removal and $250 for disturbing the ground.
I was in a campground at the national forest to which the forest website states is ok to search in unless otherwise marked historical. I just happen to be searching the day an archeologist was at the park, which apparently had logging activity on it. They said it was not marked because they didn't want people to specifically seek it out to loot. My other finds were hotwheels and clad.. They took them all and bagged them in evidence bags.

The forest dept said it wasn't developed enough and that's why we were being fined ($500 each for the three of us). We had to pay for the $3000 in time the archeologists had to come back and spend on the site to report the damages....I am welcomed to come back anytime, just let them know before I do...... I had to be fined because if they didn't I would go out an tell everyone the forest dept is lenient and would just slap you on the wrist....

So if you are looking for coins and find a 50 year old anything, better leave it as is and do not throw it away even if it is garbage.(removal) Thats what I was told.

So then : How do you figure that our show & tell sections, on-this-very-forum, are FILLED with us md'rs , showing off our latest old coin finds then ? Made from (gasp) , parks, school yards, beaches, forests, etc...... We're all just a bunch of lawless miscreants I guess. Because *SURELY* every passerby is aghast, cares a ton, notices, worries, etc.... Right ?

Ha! It was so ridiculous.

They told me they have an old gas station site that was torn down years ago that the government won't let them clean up the garbage (old oil cans and such) because it is over 50 years old....

And FYI - this is on a federal level, not state.
I hunt several lakes where I am at all are off limits to detectorist say Indian burial grounds . Yet when they put in cottages they bulldozed them flat lol .
No dead Indians never where they were ceremonial mounds anyhow still detect at wee hours if harassed will point to park rules nothing about detecting on it . sube

I do not deny that there are purist archies that, yes, are aghast at anyone "disturbing the past". And if you go swatting a bunch of hornet's nests asking "Can I ?", then your/our "pressing question" will land on one of these guys' desks. Right ? So then we all run and shudder thinking "the sky is falling" and "everyone hates us", right ?

But this is a little like asking an animal rights wacko advocate ("P.E.T.A" type person) : " Hi, can I leave my pet bunny in the car, while I run into 7-11 to get a slurpee ?" Guess what answer they will give you ? They will screech :

"NNNEEOooooo ! The bunny will suffer in the hot sun. You can be arrested for animal cruelty. Your car can be confiscated" :roll:

blah blah blah. And they might even be able to cite some chapter and verse that actually says-such-things. But let's be dreadfully honest : Did anyone else CARE LESS if you left the bunny in the car ? OF COURSE NOT ! So too is it with our metal detecting : The type persons who *might* "care less" are going to be one in 500,000 persons. So....... seriously now........ what are your odds of running into them ? I still say that the average passerby, and the average land-owner (whose tenant gave you permission), DO NOT CARE , nor hate md'rs, blah blah

IDK, again ridiculous...... that's where I laugh at the people that are so morally against the question of the thread.... yet would justify taking a 50 year old item from public property because they "think" it is garbage..... Sorry but you can go both ways and pick which "laws" you want to follow.... I feel safe to say we all broke this law at somepoint and felt good about cleaning up a park.

In reality we are finding old lost junk that nobody gives 2 sh*ts about unless they can find a reason to complain about it.

Oh well gee, let's not "mince words" then. When anyone here goes to seek permission from an agency (as if it's needed), you don't say "Hi can I metal detect ?". You say : "Hi, can I disturb & alter Indian bones". :roll: After all, you want to make sure they understand the full implications of the evil-ness of our hobby, right ? You wouldn't want to "mince words", right ?
 
After all that talk about bending over in prison you have greatly angered the metal detecting gods with this follow up post.... and I am no longer interested in joining a prison.

Well, given the stance of several folk here, the answer to that ^ ^ seems to be : "Yes".

And have the property owner (or city-hall or whatever) fill out a legal Search & Salvage contracts. Holding you & them harmless for lawsuits. After all, you "can't be too safe", eh ? And be sure to alert them to potential to disturb Indian bones. And when it comes to the items you might "find", you don't use the word "find", you use the word "steal". And when it comes to reference that you'll dig, you don't say "dig", you say "destroy and destruct". Because you don't want to be less-than-forthcoming, eh ?

Get all this ^ ^ down in a contract. Otherwise you are SURE to "end up in jail". Because *SURELY* everyone hates us, and is waiting to bust our chops, hates our hobby, blah blah blah. Right ?
