I'm going down there in September, hopefully and here is what I have found out so far. It is legal to detect anywhere in Nags Head north to the Virginia state line. No detecting in the "National Seashore" Which is somewhat south of Nags Head. I saw something in a thread about from the high tide water line down to the ocean was okay. I think the dry sand depends on what private house or hotel it is in front of although I'm not sure on that one. Check out "soda pop priates" web site, they are in the OBX and have some really cool finds on that website. Hope some of this has helped, good luck, post your finds and save some for me:spin:

I detect in the OBX at least once a month. North of Nags Head is OK. If your on Hatteras Island (National Seashore) the rules are no MD'ng. Don't know where I read it but it didn't say anything about the high tide line. I think their words were,"Metal Detecting is Illegal". Trust me, if they allowed it, everybody and his brother would be there. I've been up and down Hatteras fishing and have never seen anyone tecting.

OK if you go to:
www.nps.gov/caha/supportyourpark/index.htm
toward the bottom of the listing it mentions not using metal detectors.
Hope this helps

Default Metal Detecting

Also, on that same website, if you go to the frequently asked questions then to Metal detecting it says:

36CFR 2.1 (a)(7) prohibits the use of metal detectors in all national parks

Allow me to clarify my previous post. I was stating that all metal detecting in the National Seashore area was off-limits. The thing about the dry sand High Tide water line I saw was in areas that metal detecting was permitted north of the National Seashore. It said something to the effect that it depended on the specefic hotel/ private home policy on metal detecting in the dry sand area in front of those structures. I do not know that to be true, I only read that in a thread somewhere, it is unverified. Thanks

Default Detecting the OBX

Sorry Booty, I may have misunderstood your thread. In reference to hunting in front of hotels, I've never had a problem. I've hunted dry sand to the water. No one has ever questioned me except for beachlovers asking me if I ever find anything. So I hunt early in the morning or later when they get off the beach

Default OBX and Detecting

A number of years ago my family and I started going to Hatteras for a week in mid summer. The other families that we went with and I never had too much in common, so it was kinda boring after a couple of days. Well then I bought a detector and took that down there to have a way to spend my time, or so I thought. I went out one morn. at daylight and started working my way north. By about mid day I got to a nice pier and was picking coins like crazy. I was quite thirsty by then and went in store on the pier to get a drink. The lady in the store saw my detector and told me " GET THAT THING PUT AWAY BEFORE THE RANGERS SEE IT" I had no clue as to what the law was and it almost cost me a nice detector. Ignorance is bliss they say and I have many a blissful moments but knowing the laws and rules is very important!
