Road Construction

I had a couple hours to kill today so I headed to a local park to do some detecting. It turned out that a road on one side of the park was torn out.

This is in an older part of town, so it could be a good opportunity. But is it okay to be detecting the road construction area?

Having just seen this article a day or two ago http://rochester.patch.com/articles/city-to-metal-detecting-sleuths-be-patient-or-be-arrested#photo-9625743, it makes me a little nervous to just assume that it's public property and therefore fair game to hunt. But who would I ask for permission?
 
It's not in the park. It's a city road next to the park. The construction continues another block past the park as well which is a residential neighborhood.
